Terms & conditions

Applicability 
All deliveries, services, and sales provided by Vliegenraam.com BV are governed solely by these general terms and conditions. Any conflicting terms from other parties are explicitly excluded. By signing the order form, the customer confirms they have read, understood, and accepted these terms without reservation. 

Orders 
Orders and any modifications are only valid if confirmed in writing via a signed order form or approved quotation. A 30% deposit is required upon order confirmation, unless otherwise agreed in writing. 

VAT Registration 
The VAT number provided by the customer at the time of order will be used in our annual VAT declaration. 

Delivery Times 
Delivery or completion dates are given for informational purposes only and are not binding. Even if a fixed delivery date is agreed upon, it may be adjusted based on Vliegenraam.com's production schedule, without entitlement to compensation.Cancellations 
If the customer cancels the order, a cancellation fee of 50% of the total amount will be charged. Vliegenraam.com BV reserves the right to claim higher damages. Cancellations must be made by registered letter at least 30 business days before delivery. Late cancellations will not be accepted, and the full order amount remains payable. Cancellation is only valid after payment of the cancellation fee. If unpaid, Vliegenraam.com may either enforce the agreement or collect the cancellation fee. 

Force Majeure 
Vliegenraam.com BV is not liable if its suppliers fail to deliver due to circumstances beyond their control. Events such as strikes, unrest, transport issues, or government actions entitle us to suspend or cancel orders without owing compensation. We may also terminate the agreement in case of insolvency, bankruptcy, or legal incapacity of the customer. 

Retention of Title 
All delivered goods remain the exclusive property of Vliegenraam.com BV until full payment of the invoice is received. 

Suspension of Delivery 
Vliegenraam.com BV may require financial guarantees (e.g., bank or mortgage security) before proceeding with delivery or installation. Until such guarantees are provided, we are under no obligation to deliver. 

Complaints 
The customer must inspect goods and completed work immediately upon receipt and report visible defects within 5 working days in writing. Hidden defects must be reported by registered mail within one month of delivery. If a complaint is deemed valid, Vliegenraam.com BV may offer a refund up to the invoice amount or replace the goods/services free of charge. Custom-made items or unreported issues will not be accepted for return. 

Liability 
Vliegenraam.com BV cannot be held liable for indirect or economic damages, loss of profit, or reputational damage. Improper use or installation voids liability. We are only liable for damage resulting from intent or gross negligence. 

Scope of Liability 
Our liability is limited to damage the customer can directly link to a breach of contract. This limitation also applies to our staff, executives, and representatives. 

Invoices & Late Payments 
Invoices must be paid within 14 calendar days. A 1% monthly interest will be charged automatically for late payments. In addition, a flat fee of 10% (minimum €125) will apply, plus potential recovery costs per the Act of August 2, 2002. Any granted payment terms or discounts lapse in case of late payment. The customer may not withhold payment, claim compensation, or apply retention rights. 

Warranty 
No warranty claims will be accepted until invoices are paid in full. 

Disputes 
All disputes fall under the exclusive jurisdiction of the courts in Antwerp, or the Justice of the Peace in Kontich for smaller claims. Belgian law applies. 

Validity 
Should any provision of these terms be found invalid, the remaining provisions remain in effect. The parties will replace the invalid clause with a legally valid alternative reflecting the same intent. 

Privacy statement agreement and marketing

Your personal data (name, email address) are processed by Vliegenraam BV to manage customers according to the contractual relationship pursuant to your instructions or the order that you place, within the scope of various statutory obligations (our liability, obligation to store and accounting law) and for direct marketing purposes (to perhaps offer you new services), on the grounds of our legitimate interest as an entrepreneur. The processing is always done by the business manager.  

We notify you that we cannot erase your data during the assignment allocated to us or the performance of the order placed because then we cannot guarantee our services. Within the scope of statutory obligations applicable to us, we are obliged to keep your personal data for a further 10 years after the assignment has been terminated (maybe by you). Data relating to you that we then store and archive shall only be those necessary within the scope of the statutory obligation.  

We must draw your attention to the fact that we can communicate your personal data to third parties within the scope of the assignment allocated to us and in execution of a statutory obligation. You can always consult us in this regard and we will then tell you to which authority your personal data have been transmitted.  

If you do not wish us to process your data for direct marketing purposes, all you need do is to tell us this at info@vliegenraam.com. At this address, you can also always ask which data we process on you and have them rectified or erased (the latter to the extent that this is possible within the scope of the allocated assignment/order placed and the law).  

If your data that have been transmitted to us are not correct and you request them to be rectified, you can always request that the data processing be restricted where possible. 

Likewise, where possible, all the services that are performed within the scope of the rights granted to you by the General Data Protection Regulation are free of charge. 

 You can address the Privacy Commission (Drukpersstraat 35 in 1000 Brussels) if you do not agree with the way in which your data are processed.
